1. Platform Description

BrickSwap is an online marketplace that enables users to buy, sell, and trade LEGO sets and related products. The platform facilitates peer-to-peer transactions between registered users, providing tools for listing items, communicating with other users, and processing payments securely.

2. User Responsibilities

By using BrickSwap, you agree to:

  • Provide accurate and truthful information in all listings.
  • Honestly represent the condition of items (new, complete, or incomplete).
  • Respond to buyer/seller inquiries in a timely manner.
  • Complete transactions you have committed to.
  • Maintain accurate and up-to-date account information.
  • Not use the platform for any illegal or unauthorized purpose.

3. Transactions and Fees

BrickSwap facilitates transactions between buyers and sellers. A platform fee of 5% is applied to each completed sale transaction. This fee covers payment processing, platform maintenance, and customer support. Swap transactions (1:1 or swap with cash top-up) are also subject to the platform fee on any monetary component.

Payments are processed through Stripe, our third-party payment provider. Funds are held in escrow until the buyer confirms delivery and satisfaction with the item.

4. Prohibited Items

The following items are strictly prohibited on BrickSwap:

  • Counterfeit or knock-off LEGO products.
  • Unsafe, recalled, or hazardous LEGO sets.
  • Stolen goods of any kind.
  • Items that infringe on intellectual property rights.
  • Any non-LEGO items (unless part of a bundled LEGO set listing).

BrickSwap reserves the right to remove any listing that violates these rules and to suspend or terminate the accounts of repeat offenders.

5. Dispute Resolution

In the event of a dispute between users, BrickSwap provides a dispute resolution process. Either party may initiate a dispute within 14 days of the transaction completion. Our team will review the evidence provided by both parties and make a fair determination. Decisions made by the BrickSwap dispute resolution team are final and binding.

6. Limitation of Liability

BrickSwap acts solely as a platform connecting buyers and sellers. We do not own, inspect, or verify the items listed on our platform. BrickSwap shall not be held liable for:

  • The quality, safety, or legality of items listed.
  • The accuracy of listings or user-provided information.
  • Any damages arising from transactions between users.
  • Service interruptions or technical issues beyond our control.

To the maximum extent permitted by applicable law, BrickSwap's total liability shall not exceed the platform fees paid by the user in the 12 months preceding the claim.

7. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Republic of Poland and applicable European Union regulations. Any disputes arising from or relating to these terms shall be subject to the exclusive jurisdiction of the courts of Poland.
